Initial Case Management Conference

An initial case management conference is the first hearing that takes place in a Hennepin County divorce. Informal in nature, the purpose of the hearing is to get acquainted with the judge who will be handling your case and allowing him/her to work together with the lawyers to formulate an efficient plan for moving your matter along. From there, couples are often referred for an early neutral evaluation.

Early Neutral Custody Evaluation

An early neutral custody evaluation provides parents with an opportunity to resolve the custody and parenting time issues involved in their divorce. The parties, with counsel, meet with two custody evaluators (one male and one female, to avoid perceived gender bias) employed with Hennepin County Court Services. Sessions last approximately three hours. Each side is permitted to respectfully state their position on the custody issues and respond to claims made by their spouse. Once the discussion has concluded, the evaluators will meet for a short time to discuss. Upon returning, they offer their impressions and predict what would occur if a full evaluation were performed. Their conclusions become part of ongoing settlement discussions.

Early Neutral Financial Evaluation

In addition to custody resolution, Hennepin County has created an early neutral financial evaluation program. This program involves the parties, and counsel, meeting with an experienced family practitioner or accountant with recognized expertise in finance and tax issues. Meetings involve the creation of a balance sheet of assets and liabilities, a proposed allocation of these items, budgets, valuation issues and the viability of spousal maintenance claims. Parties routinely meet with the evaluator several times over a 60 day period.
