# Utah Residents May Find Mediation to Be a Helpful Tool | Brown Family Law

Utah residents facing divorce could find it an emotionally trying time. While there are several avenues available to navigate a divorce, some find mediation helpful. The attitude and overall demeanor of the involved parties may play a part in a successful mediation.

This confusion could possibly lead to unrealistic expectations and possible disappointing outcomes, which could lead to a less positive outcome. Understanding the differences between mediation and arbitration may allow divorcing couples to approach the situation with a much more positive attitude and increase the probability of achieving a mutually successful outcome.

Where arbitration involves a neutral third party making the final decision in favor of one of the parties, mediation uses a neutral third party to only act as a facilitator between the two parties. The appeal of mediation comes from the fact that it encourages the parties to do the negotiating in hopes of reaching a positive agreement. This can be a helpful tool for those that just need a neutral party to act in the best interest of both.
