Utah Divorce Order to Show Cause: Order to Show Cause

In previous posts, I’ve given you Brown Family Law’s template for its Motion for Order to Show Cause, as well as its Sworn Declaration.

I’ve also laid out what an order to show cause is, and the potential penalties/punishments for violating a divorce decree.

Today, I’ll give you the third and final document you have to file with the court when you file an order to show cause (i.e., a motion for contempt).

This document is the Order to Show Cause itself.

Wait, I Thought We Had Been Talking about the Order to Show Cause the Entire Time

So, if you haven’t noticed, lawyers have an interesting way of speaking. Never is this clearer than when attorneys talk about orders to show cause.

When lawyers talk about filing an order to show cause, what they’re referring to is the whole set of documents given to the court attempting to prove someone violated a Utah divorce decree.

The problem with this language is one of the documents in the set is actually called Order to Show Cause. So, order to show cause refers not only to the whole set of documents, but also to one specific document.

Honestly, only lawyers know when they’re referring to the set or the specific document, and we only know from the context of the conversation.

So, What Is the Specific Document Called Order to Show Cause?

Now that we have that cleared up, let me explain the specific document called Order to Show Cause.

The Order to Show Cause is, at its essence, a notice to come to a specific place at a specific time to explain to the Court why you have not violated your divorce decree.

It’s a glorified notice of hearing.

The Order to Show Cause itself doesn’t contain much information. The meat of the matter is contained in the Motion for Order to Show Cause and accompanying Sworn Declaration.
