Utah Divorce Default Paperwork — Findings of Fact and Conclusions of Law

The other day, I posted our internal Utah divorce default checklist.

In some of the nest posts, I’ll provide the documents mentioned in the checklist. These are the documents we actually use in our divorces.

First document is the Findings of Fact and Conclusions of Law we use. This document is specific to defaults, so it has language we wouldn’t normally use in other Findings and Conclusions.

The above-entitled matter came before the Honorable XXXX XXXX. Petitioner is represented Marco Brown, of Brown Family Law, LLC. Respondent, acting pro se/represented by XXXX XXXX, was regularly served but failed to appear in person or otherwise file responsive pleadings, and the Court therefore enters Respondent’s default. The Court, having received Petitioner’s proffered Findings of Facts and Conclusion of Law and the proffered Decree of Divorce Order, having reviewed the file in this matter, and being otherwise fully advised, enters its:

FINDINGS OF FACT

Cut and paste all paragraphs from the Sworn Complaint for Divorce here. Change any paragraph referencing an exhibit to read “Attached as Exhibit X to Petitioner’s Sworn Complaint for Divorce.”

CONCLUSIONS OF LAW

The Court concludes Parties are subject to the jurisdiction of the Court as set out above under the Court’s Findings of Fact, and Petitioner is entitled to a Decree of Divorce based on Respondent’s default and pursuant to Petitioner’s Sworn Complaint for Divorce, the same to become final upon entry herein. The Court concludes that all other issues of dispute have been resolved by the Court pursuant to the above Findings of Fact.
