Utah Divorce Subpoena: Custody Evaluation Records

In some Utah divorces involving child custody a custody evaluation is necessary.

Quickly, a custody evaluation is an evaluation by an expert (usually a psychologist or LCSW) regarding child custody and parent-time. (If you want to read more about custody evaluations, click here.)

If you end up going to trial after a custody evaluation and the subsequent 4-903 conference (read more about those here), you’ll want to subpoena the custody evaluator’s records and review them before trial.

And here’s the subpoena sample for getting those records:

All records regarding the custody evaluation you performed concerning XXXX, date of birth XXXX XX, XXXX, Social Security Number XXXX, and XXXX, date of birth XXXX XX, XXXX, Social Security Number XXXX. This request includes all of the following: your notes (handwritten and otherwise), psychological testing data and results, questionnaires, letters received regarding the evaluation, criminal histories, police records, drug histories, Division of Child and Family Services documents, records from all other governmental entities, video and audio recordings, supervised parent-time records, drafts of your written recommendations, emails, communication logs, and any other records regarding the evaluation.
