Pension and retirement benefits need to be divided according to guidelines stated under the Uniformed Services Former Spouses’ Protection Act. This act protects spouses of military members if they are entitled to their spouse’s military pension. The amount a spouse can receive is based on the benefits accrued during the length of the marriage.
